Brampton files often turn on two questions: whether a basement unit is registered with the city, and what a builder agreement actually commits you to. We close purchases, sales, refinancings, and title transfers across Brampton.

Our Thornhill office is a direct drive from Brampton along the 407 to the 404. In-person signing is available there, and remote identity verification and document signing are also available for clients who prefer not to travel.

What matters in a Brampton closing

Second units and city registration

Brampton requires a second unit to be registered with the city. A basement apartment that has not been registered is a legal question on the file, not just a feature of the listing.

More details

Brampton has more second units than most Ontario municipalities, and the city requires each one to be registered. A listing that advertises a basement apartment or in-law suite does not tell you whether it is registered, whether it was built under a permit, or whether it meets fire and electrical requirements. Where the rental income is part of your financing, the difference matters to the lender as well as to you, and it is a question to settle before the agreement is firm.

Builder subdivisions and new construction

Mount Pleasant, Bram West, and northwest Brampton carry a large share of new freehold construction, where the builder agreement governs and there is no statutory rescission period.

More details

Brampton's newer subdivisions bring Tarion coverage, builder agreements, closing adjustments, and dates that shift. A freehold new build does not carry the statutory rescission period that applies to a new condominium unit, so whatever review window exists comes from the agreement itself. We look at the adjustments the builder is entitled to charge at closing, the delayed closing provisions, and whether the agreement permits assignment before you sign, wherever that is possible.

First-time and multi-generational buyers

Many Brampton purchases put more than one household on title, which changes how the first-time buyer rebate and the form of ownership need to be handled.

More details

Brampton has a large share of first-time buyers and of families purchasing together across generations. When more than one buyer goes on title, the form of ownership needs a decision, joint tenancy or tenancy in common, and the provincial first-time buyer rebate depends on whether every buyer qualifies. Where some do and some do not, the rebate is affected, and that is worth knowing before the offer rather than at registration.

How the tax works

Only the Ontario land transfer tax applies to a Brampton purchase. Brampton sits in Peel Region, where no municipality charges a land transfer tax of its own. Toronto remains the only Ontario municipality with a second tax.

The provincial tax is calculated on a graduated basis against the purchase price and is payable on closing. First-time buyers may claim the provincial rebate up to its maximum, applied at registration. Where several buyers go on title and not all of them qualify, the rebate is affected, so the ownership structure is worth settling early.

Real estate matters in Brampton

  • Residential purchases

We review your agreement before the conditions come off, search title, and carry the file through to the day you get the keys.

  • Residential sales

We answer the buyer's requisitions, arrange the discharge of your existing mortgage, and account for every dollar leaving the transaction.

  • Refinancing and new mortgages

Whether you are moving lenders, taking equity out, or adding a second charge, we handle the registration and the discharge that follows it.

  • Title transfers

Adding a spouse, removing a name, transferring to family, or updating title after a death. Each one carries tax and mortgage consequences worth understanding first.

  • New construction and builder purchases

Builder agreements are written for the builder. We read yours as early as we can, and where a statutory rescission right applies, inside that window, while there is still something you can do about it.

  • In-person and remote signing

In-person signing at our Thornhill office is our standard approach, and remote identity verification and document signing are available if you prefer. Remote signing changes how you meet with us, not the lawyer-led legal work performed on your closing.

Common questions

Brampton real estate questions

Does Brampton charge its own land transfer tax?

No. Only the provincial land transfer tax applies to a Brampton purchase. Toronto is the only municipality in Ontario with a municipal land transfer tax, so a Brampton closing does not carry that second cost.

The house has a basement apartment. Does it need to be registered?

Brampton requires second units to be registered with the city. Whether the one you are buying is registered, was built under a permit, and meets fire and electrical requirements are separate questions, and a listing does not answer any of them. Raise it with us before the agreement is firm, especially where the rental income is part of your financing.

Do you handle builder purchases in Mount Pleasant and Bram West?

Yes, and the review is most useful before you sign. These subdivisions are largely freehold, which means there is no statutory rescission period to fall back on; that right applies to new condominium purchases, not to freehold builds. We look at the adjustments the builder can charge at closing, the delayed closing provisions, and whether assignment is permitted.

We are buying with my parents. How does that affect the first-time buyer rebate?

The provincial rebate depends on whether every buyer on title qualifies as a first-time buyer. Where some do and some do not, the rebate is affected. The form of ownership, joint tenancy or tenancy in common, is a separate decision with its own consequences. Both are worth settling before the offer rather than at registration.

Do I need to come to Thornhill to close a Brampton purchase?

Not necessarily. Our Thornhill office is available for in-person signing. If you would rather not travel, we can complete identity verification and document signing remotely. Remote signing changes how you meet with us, not the lawyer-led legal work performed on your closing.
